(The definitions used in this announcement shall have the same meanings as defined in the announcements dated 30 April 2026, 22 May 2026, 4 June 2026 and 2 July 2026 unless stated otherwise.)
Reference is made to the Company's announcements dated 30 April 2026, 22 May 2026, 4 June 2026 and 2 July 2026 in relation to the Winding-Up Petition served on West River Engineering Sdn. Bhd.
The Board of Directors of WRB wishes to announce that at the Hearing held on 8 September 2026, the Petitioner withdrew the Winding-Up Petition. The Court accordingly ordered, inter alia, as follows:-
i) that the Winding-Up Petition be withdrawn with liberty to file afresh, with costs of RM5,000.00 to be paid by the Petitioner to WRE; and
ii) that WRE's striking out application be struck out, with costs of RM2,000.00 to be paid by the Petitioner to WRE.
The withdrawal of the Winding-Up Petition did not arise from any settlement, compromise or payment by WRE in respect of the alleged debt, and no admission of liability has been made by WRE. The Court did not make any determination on the merits of the alleged debt, which remains disputed by WRE in its entirety.
In light of the above, there is no longer any subsisting winding-up petition against WRE and the aggregate costs of RM7,000.00 awarded in WRE's favour are to be paid by the Petitioner.
Further announcement will be made should there be any material development arising from or in connection with this matter.
